HB892 and SB250 would prohibit state agencies from inquiring about criminal history on employment applications.
Unemployed former offenders are 2.1 times more likely to be re-arrested than employed former offenders.
75% of former offenders remain unemployed for up to one year after release.
Discriminating based on criminal history has become a liability for Virginia: The Equal Employment Opportunity Commission (EEOC) has started to take actions against employers that fail to hire somebody solely due to a criminal background.
SB250 and HB892 do not effect law enforcement agencies or positions designated as sensitive positions; they are exempt from the changes
Businesses are missing out on qualified applicants because they are making assumptions about ex-offenders before interviewing them. Employers have the right to know a potential employee’s criminal background, but should not be allowed to discriminate based on that one factor. SB250 and HB892 are about giving people the ability to successfully re-integrate into society by helping them get past the first hurdle in the job application process.
